Shine Terms of Use

A. Definitions
“You” or “your” refers to the end user.
“We”, “us”, “our”, and “Developers” refer to the developer(s) of the Shine program, as explicitly stated in the “About” section of the program, or on any other location that we determine appropriate, such as a website.
“Third-Party software” refers to third-party libraries the Developers have used to add functionality to Shine, in a compiled form. These libraries are subject to their own terms, along with the respective language in these terms.
“API” refers to the library (or libraries) included with Shine to allow other developers or end users to extend or otherwise add functionality to Shine. The API is also subject to its own terms, along with the respective language in these terms.
“Shine” refers to the Shine program, in both its compiled and source forms, along with any libraries that Shine depends upon to provide functionality to the program, and that are not Third-Party software or API. This does include the Shine Add-ins for Microsoft Office.
“Add-on” refers to a piece of code, usually in a compiled form, created using the API by another developer or end user. Add-ons are subject to their own terms, along with the respective language in the API terms, and these terms.
“Calendars” refer to files that contain calendar information, such as events, tasks, and descriptions of such items, that are created and/or edited by Shine as the result of user interactions with the program.
“Internet Calendar Providers” and “Providers” refer to services available through the Internet which stores calendars online, which Shine is able to access (through your permission) for the purpose of displaying, editing, and in any other way modifying your data.
“Current Terms” refers to the most recent and current version of these terms, as available publicly online on a website owned and operated by the Developers, indicated as the current version of these terms.
“Google Drive” refers to an online cloud service that is promoted and provided by Google, which is in no way affiliated with the Developers or Shine.
B. Licensing
We provide to you a license, which cannot be transferred or sold, to use Shine on devices that you own, as defined in section C. This does not make you the owner of your copy (or copies) of Shine, only the receiver of a license to utilize it.
We provide you the right to use your copy (or copies) of Shine as long as you abide to these terms, and any other applicable terms mentioned within. You may store and utilize one or more copies of Shine on one or more devices that you own which have an operating system, and you may also store a single copy for backup purposes on optical or physical storage media that does not have an operating system. You have the right to use Shine for personal, commercial, governmental, or other means, as long as that usage does not go against these terms. You also have a right to your privacy, as outlined in section F and elsewhere in these terms, as well as through laws or regulations as outlined in section J. This does not guarantee you any other rights in relation to this software. The Developers reserve all other rights.
If you perform actions that do not abide to these terms, if you do not wish to abide to these terms, or if we declare you as not abiding to these terms, you must remove all copies of Shine from your devices. Abiding to these terms is required in order to use Shine. If these terms are replaced by new terms, abiding to the new terms are required in order to use Shine, as outlined in section K.
You are not allowed to sublicense, sell, rent, lease, or transfer your copy (or copies) of Shine to another individual, business, or customer. You are not allowed to place your copy (or copies) of Shine in a public location that can be easily accessed by another individual, business, or customer (except for making this copy (or these copies) available to others who use the computer it is installed on, through appropriate means).
We may provide and display to you an abridged version of these terms. The abridged version we display is for your convenience and to educate you about these terms. The abridged version does not replace these full terms as the terms you must abide to. You must still abide to these terms even if you are only displayed the abridged version of these terms. The Developers are obligated to provide to you a method to view these full terms.
In the situation of any discrepancies or confusion, the Current Terms, as defined in section A, will be the reference used in regard to interpretation and adherence, and will be considered the most complete version of the terms that must be abided to. The Developers may make publicly available older versions of the terms, but we are obligated to indicate which version is the current one which will be used as the reference as outlined here.
These terms (or Current Terms) and this license apply additionally to all updates, supplements, and other content that are provided to you to interact with the Shine program. These terms and this license additionally apply to all components to Shine, as well as all files utilized by Shine to perform its functions (as defined in section C), even if separated from the rest of Shine.
These terms (or Current Terms) function as the entire agreement between you and the Developers, unless expressed otherwise in a written form.
C. Usage
We permit you to utilize all functionality included within your copy of Shine which are accessed by standard means (such as launching the executable, and interacting with the GUI that it provides). This functionality may include, but is not limited to: creating or editing Calendars or event data, accessing Calendars or event data stored by Internet Calendar Providers via means established within the GUI, and installing and using Add-ons. We reserve the ability to determine if any usage is against these terms, and thus declare you as not abiding by these terms. You may not utilize this software in any way that is considered against the law.
You may not work around any intentional limitations of Shine. You also may not reverse engineer, decompile, or in any other means attempt to obtain or determine the source code for Shine. You may not modify any part of Shine for the function of viewing, adding, modifying, disabling, or removing functionality or features, beyond what Shine itself allows through standard usage.
Shine creates, edits, and utilizes various files on your computer for the purpose of performing its functions; some of these files are not intended to be accessed or modified by you directly. You may access, view, modify, and store a copy of these files, but you assume all risk and responsibility in doing so. However, you may not access, view, modify, or store a copy of these files as a means to work around limitations or to gain access to accounts or data that you are not otherwise allowed access to.
While you have a right to your privacy, and we wish to respect and uphold that in any way that we can, we may collect information about your usage of Shine, its API, or the Calendars or event data that have been created or otherwise accessed by your copy of Shine. This collected information will not be used for the intent of personally identifying you. This information may be analyzed by the Developers, or on the behalf of the Developers, to improve Shine, its API, and/or any Third-Party software. This is outlined in section F.
D. Calendar Files
Any Calendars or event data that are created or accessed as a result of user interactions with Shine, are your property. If the Calendars or event data are stored through the means of an Internet Calendar Provider, additional terms may apply, including terms regarding ownership of data.
Barring limitations provided by Internet Calendar Providers or their terms, you are permitted to utilize, share, transfer, or in any other way make decisions regarding or as a result of your Calendars or event data as you see fit, as long as it is not to perform actions considered illegal, or to perform actions that will go against these terms.
Any information from Calendars or event data that is collected will not be used for the intent of personally identifying you. This information may be analyzed by the Developers, or on the behalf of the Developers, to improve Shine, its API, and/or any Third-Party software. This is outlined in section F.
E. Feedback
If you provide feedback to the Developers, including via the means included with Shine, via email or via any other form of contact, you allow the Developers to use, share, or in any other way act upon the feedback you provide, without limitations and without payment. The Developers are not under any obligation to act upon the feedback you provide. If the Developers do act upon your feedback, they have no obligation to provide you credit, compensation, or in any other way personally identify you.
F. Privacy
Shine may include some data collection tools, which can all be enabled and disabled by you.
Some of these tools may collect information about your usage of Shine, its API, the Calendars or event data that have been created or accessed by your copy of Shine, or the computer or device that Shine is running on. This information is collected to be analyzed by the Developers, or on behalf of the Developers, to provide statistical data and to improve Shine, its API, and/or any Third-Party software, by way of providing information about the usage of Shine (in regards to which features are utilized and how these features are utilized) and the computer or device Shine is running on.
These tools will not collect personally identifiable information, nor will the data collected by these tools be used for the purposes of personally identifying you. This data is to be collected on a monthly basis, and will be discarded within 6 months of being collected. However, statistics and information that are created as a result of this data may remain beyond 6 months.
These tools do not collect the names of Calendars, event data, account data, nor information such as e-mail addresses. However, information based upon these names may be collected, such as if a name contains a special character.
Some tools may collect information about errors, issues, problems, and unintended occurrences that may occur throughout usage of Shine. The information collected by these tools is to help identify these errors and unintended occurrences, and to collect relevant information about Shine and the computer or device Shine is running on. This collected information will be utilized for the purposes of providing statistical data, and providing information to assist in remedying these errors in future updates.
These tools may collect personally identifiable information, but this information, if collected, will only be utilized for the purposes of assisting in remedying these errors in future updates, and providing services that we are legally required to provide (such as the Right to be Forgotten). This information will not be utilized for the purposes of personally identifying you. Once an error is remedied, fixed, deemed unsolvable, or otherwise dismissed or discarded, this data will be discarded.
Some tools may collect information about the Add-ons installed or utilized by you. This is to provide statistical data in regard to Add-on usage, and to provide functionality outlined in section H. These tools may collect personally identifiable information, but this information will not be used for purposes of personally identifying you. This information will be used to provide services that we are legally required to provide (such as the Right to be Forgotten). This data will be discarded within 6 months of being collected. However, statistics and information that are created as a result of this data may remain beyond 6 months.
All data collected and used here are not shared with any other parties nor used for the purposes of advertisement. However, statistics and information that are created as a result of this data may be used for advertising, marketing, and shared with other parties; others will be unable to use these statistics and information to trace back to any individual person’s data. All data collected is aggregated, and all statistics and information shared is anonymized.
Shine allows you to connect to Google Drive through its interface, but we do not collect any data about your Google Drive files. Shine’s connection to Google Drive is limited to the features presented to you through its interface. Shine does not collect, store, or share your Google Drive data. Third-Party software and Add-ons do not have access to Google Drive data beyond any individual files that the user has added as attachments to events. We may collect data about event attachments in regard to if an attachment is a Google Drive item, but we do not collect data about what the attachment is, the contents of the attachment, nor any information that could uniquely identify an attachment.
Third-Party software and Add-ons, including Third-Party software utilized for communication with Internet Calendar Providers, may collect data as well. This software is governed by their own Privacy Policies and the Developers are not responsible for the actions of the Third-Party software in this regard. Add-ons are required to follow privacy guidelines that we outline in the terms of use of the API.
G. Third-Party Software
The Developers utilize Third-Party software to add or extend functionality to Shine. By distributing this Third-Party software with your copy of Shine, the license to use this Third-Party software is provided to you by the Developers, rather than by the developers or maintainers of the Third-Party software. The licenses to this Third-Party software is included with Shine for your convenience. You must abide by these licenses to utilize the Third-Party software, and utilize Shine.
If you do not abide to the licenses of the Third-Party software, then we may declare you to not be abiding to the terms outlined here, and must remove all copies of Shine from your devices, as outlined in section B. You must abide to the licenses of the Third-Party software to use Shine.
Most of the Third-Party software distributed with Shine is unmodified from any copies available in other locations, whether on the Internet or elsewhere. The Developers are not obligated to provide a copy of the source code for these Third-Party software. The Developers are obligated to provide a way to view the licenses for these Third-Party software.
Third-Party software distributed with Shine that have modifications which are not generally available in other locations, whether on the Internet or elsewhere, are modified in accordance to the licenses or terms governing that software. The Developers are obligated to provide information as to what Third-Party software is modified, to provide a way to view the licenses for this Third-Party software, and to provide a source copy of the Third-Party software upon request.
H. Add-ons and API
You are allowed to install and utilize Add-ons that are made available for Shine, as long as you abide to the license and terms of each Add-on, if applicable, and as long as you do not use the Add-on to go against these terms or the terms of use of the API. To reiterate, an Add-on may include an additional license or terms that you must abide by to utilize the Add-on.
The Developers may collect information as which Add-ons are installed on your device(s), and how you utilize these Add-ons, as outlined in section F. The Developers also reserve the ability to disallow the installation of, or to uninstall, an Add-on, if it is determined to go against these terms or against the terms of use of the API.
You are allowed to create an Add-on to extend or add functionality to Shine, as long as you utilize the API included with Shine, and abide to the terms of use of the API. You are allowed to apply any additional license or terms with your Add-on. You can add any functionality to your Add-on as long as it does not involve: going against these terms or the terms of use of the API, providing the source code for Shine, preventing end users from accessing and utilizing all features of Shine available to them, and preventing the Developers from collecting information as outlined in section F.
The Developers are not obligated to allow other users to install your Add-on. The Developers are obligated to display any additional license or terms prior to installation or activation of an Add-on, provided that you provide these license or terms via the means that the Developers make available to you.
You may not work around any intentional limitations of the API. You may not reverse engineer, decompile, or in any other way attempt to obtain or determine the source code for the API or for Shine, beyond what the Developers already have provided to you. The Developers reserve the ability to determine if any usage of the API, or any Add-on, is against these terms, and thus declare you as not abiding by these terms.
I. Warranty
The Developers are not obligated to provide any support or services in relation to Shine, its API, any Calendars, and any Third-Party software. Shine, its API, and any Third-Party software is licensed to you “as-is”, and you bear the risk of using it. These terms do not provide a warranty from the Developers, including express or implied, for Shine. We are not obligated to provide recovery or compensation to any damage, including direct damage, consequential damage, loss of profit, loss of data, indirect damage, or incidental damage, as a result of using Shine, its API, and any Third-Party software.
The Developers are not obligated provide any support in relation to any Add-ons that you may install, activate, and/or use. All Add-ons are without warranty from the Developers. If an Add-on has additional licenses or terms, it may include support or a warranty. We are not obligated to provide recovery or compensation to any damage, including direct damage, consequential damage, loss of profit, loss of data, indirect damage, or incidental damage, as a result of installing, activating, and/or using an Add-on.
This section still applies even if the Developers are aware of the possibilities of such damage occurring, or should have been aware of such possibilities. This section may not apply based upon certain laws or regulations, as outlined in section J.
J. Applicable Laws and Exceptions
Depending on the state or country that you reside and/or do business in, there may be laws, legal documents, regulations, or other statements of primary authority that provide rights or other permissions that contradict with the terms of this agreement. In all cases, and only these cases, where these contradictions occur, the statements of primary authority will have prevalence or superiority over these terms. All other parts and text of these terms will continue to have authority and be in effect.
If you live in the United States, Wisconsin law applies to the interpretation of these terms, and to any declarations of you not abiding to these terms. If you live in a different country, the laws of where you reside apply. As outlined in section B, the version of these terms available publicly on a website owned and operated by the Developers and indicated as the current version, will be the reference used in regard to interpretation and adherence of these terms.
K. Expiration and Changes
These terms do not have an expiration date. As long as you utilize Shine and its API, and as long as there is a legal entity that upholds these terms, these terms will apply, with the exception of the paragraph below.
If there are any changes made to these terms, the changes and new terms will wholly replace the existing terms and the existing terms will no longer be applicable. The Developers are obligated to provide you notification if there are any changes, and display to you a means to access the new terms. By continuing to utilize Shine (or accessing files which are used by Shine to perform its functions) after these changes were made, you automatically agree to these changes and the new terms. If you do not wish to agree to the new terms, you must remove all copies of Shine from your devices. As outlined in section B, the Current Terms will be the reference used in regard to interpretation and adherence.
The Developers are not obligated to agree, abide, or adhere to any changes that you may make to these terms.
